Apotex sought permission from the Food and Drug Administration (FDA) to manufacture the generic version of Dymista nasal spray before the patent expiry. However, generic drug maker Cipla Ltd and its American partner Meda Pharmaceuticals Inc. have jointly sued the Apotex group in the US to defend patent rights for its Dymista nasal spray, which is used to treat seasonal allergic rhinitis.

This lawsuit and patent expiry are hampering the growth of the market.
